After a parking mishap, a Tesla owner voices concerns over the Smart Summon feature and legal ambiguities in driverless technology usage.
When George Ghazzoul opted for a Tesla, it was not merely the sleek design that appealed to him but a profound admiration for technological innovation. "The real allure was the continuous software updates and the exciting new features that came with them," he explained. However, his enthusiasm took a downturn after a recent incident involving Tesla's Smart Summon feature—a tool that lets the car autonomously navigate to the owner using GPS.
This feature promises convenience akin to a personal valet, but for Ghazzoul, it led to an unfortunate event at the Fairview Shopping Centre on April 10. Intending to demonstrate the feature's capability, he activated Smart Summon to retrieve his car. Unfortunately, the vehicle unexpectedly swerved and sideswiped an adjacent car, resulting in thousands of dollars in damage.
Following the accident, Ghazzoul reached out to Tesla seeking accountability for what he believed was a malfunction of their technology. However, Tesla deflected responsibility, advising him to contact his insurance provider. To Ghazzoul's dismay, his insurance company held him solely at fault for the mishap.
Adding to his frustration, Ghazzoul later discovered that operating such driverless technology in public spaces like parking lots is not even legal in Quebec. "The regulations predate these innovations," noted George Iny, director of the Automobile Protection Association. He emphasized the dual responsibility of drivers to understand local laws and of manufacturers to inform customers about where and how new features can be legally utilized.
Tesla's silence in response to inquiries highlights a broader issue of corporate ethics and responsibility. "It's concerning when a company sells a feature that is impractical for the vehicle’s registered location without clear instructions on its use," Iny added, suggesting that disabling such features in markets where they are illegal could prevent such incidents.
Despite the financial and legal headaches, Ghazzoul is grateful that no injuries occurred. Still, he remains burdened with the damages to avoid hikes in insurance premiums and expresses his disappointment with Tesla. His story serves as a cautionary tale for other drivers eager to test new automotive technologies: always verify the legality and functionality of new features before use.
Ghazzoul’s experience raises important questions about the rapid pace of automotive innovations and the readiness of laws and corporate practices to adapt to technological advancements.
